Terms of Service

1. About Apex Heritage

Apex Heritage is a property management software-as-a-service platform operated by Akingate Ltd (“we”, “us”), a company incorporated in England and Wales. Apex Heritage is a trading name of Akingate Ltd. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

2. Service description

Apex Heritage provides tools for residential property management in England, including tenancy lifecycle tracking, compliance reminders, rent ledger, document storage, maintenance issue logging, approved tenancy agreement building, and AI-assisted legislation summaries. England is the only supported jurisdiction.

3. Subscriptions and billing

• Subscription fees are as shown on the Pricing page and billed monthly or annually in advance.
• The Free tier is available while we offer it; we reserve the right to change features at any time with reasonable notice.
• Payments are processed by Stripe. Card data is not stored by Apex Heritage.
• Paid subscriptions renew until cancelled. Upgrades take effect immediately with prorated billing through Stripe; downgrades take effect at the next renewal.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period, with access retained until expiry. No automatic refunds are issued for partial periods unless required by law or explicitly agreed by us.

4. Acceptable use

• You must not use Apex Heritage for unlawful purposes or in violation of applicable landlord-tenant legislation.
• You are responsible for the accuracy of data you enter, including property addresses, tenancy dates, and financial records.
• You must not attempt to access data belonging to other users, circumvent access controls, or reverse-engineer the platform.

5. AI features

Tenancy agreements are assembled deterministically from approved wording and the details you enter and confirm; AI does not write or change their legal clauses. AI-assisted legislation summaries are provided as general information, not legal advice, and may be inaccurate. Do not rely on them as a substitute for professional legal advice.

6. Intellectual property

Akingate Ltd owns the Apex Heritage service and its content. You retain ownership of the data you upload. You grant us a limited licence to process your data to provide the service.

7. Liability and warranties

The service is provided “as is”. We do not warrant uninterrupted or error-free operation. To the extent permitted by law, our liability is limited to fees paid in the 12 months preceding the claim. Nothing excludes liability for death, personal injury, or fraud caused by our negligence.

8. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protection rights you may have under the law of your country of habitual residence.

9. Changes to these Terms

We will give you at least 30 days’ notice of material changes by email. Continued use after the effective date constitutes acceptance.
